A BILL to amend article four, chapter twelve of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section fifteen, relating to allowing facsimile or electronic signatures on transmittal requests.

Be it enacted by the Legislature of West Virginia:

That article four, chapter twelve of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section fifteen, to read as follows:
ARTICLE 4. ACCOUNTS, REPORTS AND GENERAL PROVISIONS.

§ 12-4-15. Allowing facsimile or electronic signature on transmittal requests.

(a) The auditor may accept signatures on transmittal requests for payment by either facsimile or electronic signatures as adequate and appropriate proof of written approval by said signatory.

(b) The signature transmitted must be appropriately registered with the secretary of state pursuant to section two, article fourteen, chapter six of this code. The signatory is also subject to the penalty provisions of section four, article fourteen, chapter six of this code.



NOTE: The purpose of this bill is to permit the auditor to accept facsimile or electronic signature for payment of transmittal requests.
